Divorced Muslim woman can seek maintenance under CrPC

Kerala HC has held that the right of a divorced Muslim woman to claim maintenance under section 125 of CrPC will not stand "extinguished" if payment under Section 3 of the Muslim Women Act 1986 was not made by her former husband.

The Kerala High Court has held that a Muslim woman`s claim of "inequitable treatment" in a polygamous marriage should be accepted by courts as ground for divorce.
